Terms of use

We run a marketplace. Sellers open a shop, list what they have, and set their own prices, shipping and return policies. Buyers browse those shops and place orders.

We are not the seller. Every item is sold by the shop that listed it, and the contract of sale is between you and that shop. We are not a party to it.

You need an account to sell; you don't need one to buy. Keep your password to yourself — anything done through your account is treated as done by you. Tell us promptly if you think someone else has got into it.

You must be old enough to enter a contract where you live, and everything you tell us must be accurate.

This is deliberate. It is why sellers keep more of what they charge and why prices here can be lower. But it also means that whatever recourse you have if a payment goes wrong comes from the method you chose and from the seller — never from us.

Payment methods differ. Some run a dispute process of their own; several offer nothing at all, and a payment sent by those is generally gone once sent. We label each method plainly at checkout, including when the honest answer is “none”. Read that label before you pay.

We do not arbitrate disputes, reverse payments, or refund anyone. We cannot: we never had the money.

• Describe things honestly. Say what a stone is, where it came from, and what has been done to it — dyeing, stabilising, heating, reconstitution. Photographs must be of the actual item.
• Only list what you have the right to sell, and what is legal to sell and ship where you and your buyer are. Material collected illegally, or restricted by protected-site, export or wildlife rules, is your responsibility to know about.
• Publish a return policy and honour it. If you say returns are accepted, accept them.
• Ship what you sold, in reasonable time, and keep buyers informed.
• Give buyers a working way to pay you and confirm receipt promptly.

You are the merchant of record for your own sales. Any tax you owe on them is yours to work out and pay.

• Read the listing and the shop’s return policy before ordering. Policies vary between shops because each seller sets their own.
• Pay the seller by the method you agreed, and quote your order number so they can match your payment to your order.
• Raise problems with the seller first. Most are ordinary mistakes and they can fix them.

An order is not paid until the seller confirms they have received the money. Until then nothing ships.

• List counterfeit, misrepresented or illegally obtained material.
• Use the site to arrange anything unlawful, or to harass anyone.
• Take payment and not ship, or claim a payment you did not send.
• Scrape, overload or interfere with the site, or try to reach data that isn’t yours.
• Impersonate another shop or person.

Photographs, video and descriptions you upload stay yours. You give us permission to host and display them so your listings work, and to show them in search results and elsewhere on the site. You confirm you have the right to use what you upload.

We may remove content that breaks these terms, and may suspend or close a shop that does so repeatedly.

Selling is organised into plans that set how many items you can have listed at once. Where a plan is paid, we'll say the price and the billing period before you commit, and you can cancel to stop future charges. Closing or pausing your shop does not, on its own, refund a period already paid for.

We try to keep the site up and your data intact, but we don't promise it will never be unavailable and we don't guarantee sales. Keep your own copies of photographs that matter to you.

To the extent the law allows: we provide the site as-is; we are not liable for what another user does, for goods sold by a shop, or for payments made between users; and our total liability to you for anything connected with the site is limited to what you have paid us in the twelve months before the claim.

Nothing here removes rights you have as a consumer that cannot be removed by agreement.

If a third party brings a claim against us because of something you did here — what you listed, what you said about it, how you got it, or how you dealt with the other party — you agree to cover our reasonable costs in dealing with it, including legal fees.

This is not about disagreements between a buyer and a seller. Those are yours to settle, and we take no part in them. It covers the narrower case where your conduct lands us in front of someone else's lawyer.

We'll tell you promptly if such a claim arrives, and we won't settle anything in your name without asking you first.

You can close your shop at any time from your settings. We may suspend or close an account that breaks these terms. Order records survive either way, because buyers and sellers both need to be able to look up what they bought and sold.

If we change these terms materially we'll say so on this page and update the date at the top. Continuing to use the site after that means you accept the change. A change to the governing law below counts as material, and we'll say so plainly rather than quietly editing it.

These terms are governed by the laws of the State of Illinois, USA.
